Terms of Service

Welcome to RideConnect, a mobile application operated by RideConnect ("we", "us", "our"). By downloading, installing, or using RideConnect (the "App"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the App.

1. Description of Service

RideConnect is a group ride coordination application designed for motorcycle riders. The App provides:

• Real-Time Group Tracking — Share live GPS locations with riding group members.
• Route Planning — Plan rides with stops, destinations, and optimized routes.
• Voice Communication — Real-time voice chat during rides.
• Safety Features — Emergency alerts, crash detection, regroup points, and emergency contact notifications.
• Navigation — Turn-by-turn navigation integrated with Google Maps.
• Ride History — View and share summaries of past rides.

2. Eligibility

To use RideConnect, you must:

• Be at least 18 years of age.
• Have a valid driver's license for operating a motorcycle (where applicable).
• Have a compatible Android device with GPS capabilities.
• Agree to these Terms and our Privacy Policy.

3. User Accounts and Ride Rooms

3.1 User Identity

• Users are identified by a self-chosen display name (alias) and a unique device identifier.
• You are responsible for the accuracy of the information you provide.

3.2 Ride Rooms

• Ride rooms are temporary, expiring automatically after 24 hours (extendable once to 48 hours).
• Each room supports a maximum of 20 riders.
• Rooms are protected by a 4-digit PIN. You are responsible for sharing room credentials only with intended participants.
• After 5 failed PIN attempts, access is locked for 60 minutes to prevent unauthorized access.

3.3 Room Administration

• Room creators ("admins") can manage stops, destinations, and regroup points.
• Admins can remove riders from a room.

4. Acceptable Use

You agree to use RideConnect only for lawful purposes. You shall NOT:

• Use the App while actively riding a motorcycle in a manner that distracts from safe operation.
• Use the App to stalk, harass, or track individuals without their knowledge or consent.
• Attempt to access ride rooms without authorization.
• Interfere with or disrupt the App's services, servers, or networks.
• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Use the App for any commercial purpose without our prior written consent.
• Share Room IDs and PINs publicly or with unintended recipients.
• Transmit offensive, obscene, or threatening content through the voice chat feature.

5. Safety Disclaimer

⚠ IMPORTANT: RideConnect IS A RIDE COORDINATION TOOL, NOT A SAFETY GUARANTEE.

5.1 Rider Responsibility

• You are solely responsible for your safety while riding. The App does not replace safe riding practices, protective gear, or adherence to traffic laws.
• Do not interact with the App while riding. Use the App only when your vehicle is stationary, or have a passenger operate it.
• The App's UI is designed for minimal glanceable interaction, but this does not make it safe to use while riding.

5.2 Emergency Features

• Emergency alerts, crash detection, and SOS features are provided as-is and on a best-effort basis.
• Crash detection uses device motion sensors and may produce false positives or miss actual incidents.
• Emergency SMS notifications depend on cellular network availability and may be delayed or fail.
• Do not rely solely on the App for emergency communication. Always carry a charged phone capable of calling emergency services (112 in India).

5.3 Navigation

• Navigation is powered by Google Maps and Google Navigation SDK. Route accuracy, traffic data, and road conditions are provided by third parties and may not be current or accurate.
• Always follow traffic signs, signals, and local road rules regardless of navigation instructions.

6. Location Data and Privacy

• The App requires access to your device's GPS to function. By using the App, you consent to the collection and sharing of your real-time location with ride group members.
• Location data handling is described in detail in our Privacy Policy.
• You can stop sharing your location at any time by leaving the ride room or disabling location permissions.

7. Intellectual Property

• All content, design, code, trademarks, and intellectual property in RideConnect are owned by RideConnect or its licensors.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• You may not copy, modify, distribute, or create derivative works of the App.

8. Third-Party Services

RideConnect integrates with the following third-party services, each governed by their own terms:

We are not responsible for the availability, accuracy, or terms of third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW:

• RideConnect is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• We are not liable for:
  • Accidents, injuries, or deaths occurring during rides coordinated through the App.
  • Failure of emergency alerts, crash detection, or SMS notifications.
  • Inaccurate routing, navigation errors, or road condition misinformation.
  • Loss of data, unauthorized access to ride rooms, or service interruptions.
  • Actions of other users within ride rooms or via voice chat.
• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

10. Indemnification

You agree to indemnify and hold harmless RideConnect, its officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Actions taken during rides coordinated through the App.

11. Termination

• We reserve the right to suspend or terminate your access to the App at any time, without notice, for violations of these Terms.
• You may stop using the App at any time by uninstalling it from your device. Uninstalling does not delete your account or the data held under it.
• Deleting your account. You can delete your account from Profile → Preferences → Delete Account. This is permanent and cannot be undone. It removes your account, your profile and health card, your ride history and safety record, and your presence in any rides you had joined — from your account and from the device you do it on. Two exceptions apply, and both are set out in our Privacy Policy: a ride you created that still has other riders in it is handed over to one of them and continues, and messages you sent in a ride's chat remain in that ride's shared record.
• If we terminate your access for a violation of these Terms, you may still request deletion of your data using the contact details in our Privacy Policy.

12. Modifications to Terms

We may update these Terms from time to time. Changes will be effective upon posting within the App. Your continued use after changes constitutes acceptance. Material changes will be highlighted upon your next App launch.

13. Governing Law and Dispute Resolution

• These Terms are governed by the laws of India.
• Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in {{JURISDICTION_CITY}}, India.
• Before initiating legal proceedings, both parties agree to attempt resolution through mediation or direct negotiation for a period of 30 days.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
